2008 HSBC Premier Referral Programme

HSBC Premier cordially invites you to share the HSBC Premier services with your family and friends, and together seek the finest financial results. In return for sharing our services, we offer you our new 4th quarter line of exquisite gifts. To receive the gifts, all you need to do is to refer a friend or relative to open up a HSBC Premier account during the set promotion period, with that account conforming to the successful referral standards, and you can receive one of the following gifts:

Terms & Conditions

[2008 HSBC Premier Referral Programme]:
We at the Hong Kong and Shanghai Banking Corporation Limited
 (HSBC), in order to encourage HSBC Taiwan customers and
 employees to refer new clients for Premier Banking, are now
 promoting the [2008 HSBC Premier Referral Programme].
 The programme is governed by the following terms and conditions:

1. The promotion period for this programme is 4Q
    2008/10/1~2008/12/31 (if sending forms by post,
    make sure postal date is stamped)

2. Eligibility for referrers:
   a)Must be HSBC ‘Premier Banking’, ‘Premier Plus
      Account’,’Select Account’, ‘Power Vantage Banking’,
      ‘Choice Banking’, ‘HSBC Direct’,‘Smart Mortgage’,
      ‘Elite Banking’, ‘Personal Line of Credit’, or
      ‘Credit Card’ customers and general account in
      Taiwan; (This promotion does not allow referrals
      tobe TCB account holders. Previous TCB account
      holders must first change their account into any
      one of the above mentioned HSBC Taiwan branch
      accounts and also conform to all rules of this
      promotion to be qualified for referral) or
   b) HSBC Taiwan employees (excluding HSBC Wealth
        Management Personal Relationship Managers & Wealth
        Management Personal Account Managers)
   c) If the participant is neither of the above, any rights to
        participate in the scheme will be automatically lost, as
        well as the chance to make future referrals and receive
        rewards.

3. Eligibility for referrers
   a) Those who have closed an account with HSBC since
        2008/04/01 are ineligible to participate in this
        programme, be it to refer others or be referred.
    b) Self-referrals are not acceptable.

4. Methods of Referral
    If you refer a new customer to this programme during the
    promotion period, then you are eligible to receive 2 cash
    coupons for VIESHOW  cinemas.
    a) The more people you refer, the more gifts you can receive.
        If you successfully refer two people then you are eligible
        to receive two gifts, if you successfully refer three
        people then you are eligible to receive three gifts, etc.
   b) Ways to refer: Using the 4Q 2008 HSBC Premier Referral
       Programme Form, write down the person you wish to refer,
        and then fax or mail it to the HSBC Marketing Department,
        alternatively, simply hand the form in to your financial
        manager or a member of the HSBC staff.
   c) The participant of the programme must confirm that those
        being referred agree to their related personal information
        being provided to HSBC for purposes such as the promotion
        of HSBC's services or products, collection, computer
        processing, use or their personal data being
        internationally transmitted pursuant to relevant laws and
        regulations. The referral will not be valid without the
        referral's consent.
   d) Steps for Referral / Gift Delivery:
        Step 1: Successfully refer someone for the programme
                (must conform to the programme's regulations)
        Step 2: The person being referred must state clearly
                 on the 2008 HSBC Premier Referral Programme
                 confirmation Form which gift the referrer
                 desires.
        Step 3: All gifts for qualified referees are sent out
                 during the middle of the month after the month
                 that they have been successfully referred.

5. Referral product: Newly opened ‘Premier Banking’
     Account (not including customers that have been upgraded
     to Premier from a previous account)

6. Set rules for successful referral
   a) For a successful referral to be carried out, a referee
        must open and successfully activate a new Premier
        Banking account during the programme's validity period
        and maintain an accumulated savings, investment, and
        insurance balance of over NT$3,000,000 for more than 60
        days.
    b) All referrals can be referred once only. If the case
        arises whereby there are two referrals of the same
        referee, then which referral is chosen is decided by
        which HSBC Premier Referral Programme Confirmation
        Form is more comprehensively completed and not which
        referral is first received. Only the referrals listed
        on the completed 2008 HSBC Premier Referral Scheme
        Confirmation Form submitted to HSBC can be awarded
        gifts.

7. Gifts
   a) There are limited amounts to each gift. If a customer
        wishes to receive a gift that is already out of stock,
        HSBC holds the right to send a different gift of a
        similar value instead without prior notification.
   b) The pictures of the gifts themselves are only
        representations and the gift itself may vary slightly
        from the pictures. If the gifts are not in new condition
        or faulty, if you contact HSBC within 7 days, they may
        be exchanged yet not for a different gift. However, if
        the gift is received in new condition, unfortunately it
        may neither be exchanged, nor traded for cash
        or vouchers.
   c) The 2008 4Q [2008 HSBC Premier Referral Programme] gift
        redeeming validity period ends 2009/02/28 (the referral's
        Premier banking account however must be opened within
        the period 2008/10/01-2008/12/31)

8. Agreement for collection and use of information
   a) By making referrals, the referrers agree to let HSBC,
        agents and gift providers to collect, process through
        computer and use their personal data for purposes such as
        promotion of businesses, services, or products.
   b) The referrers authorize HSBC to collect, process through
        computer, use or transmit internationally their personal
        data pursuant to relevant laws and regulations for
        purposes, as defined by HSBC, such as providing and
        retrieving credit, and other HSBC services.

9. Applicable laws and tax
   a) The gifts used in this programme are purchased by HSBC
        from the participating provider. The participating
        provider is entirely responsible for resolving
        disagreements arising between referrers and the
        participating provider and relevant legal issues
        concerning the product and services provided by the
        participating provider. HSBC will provide assistance
        only upon request.
    b) This programme is obligated under the regulation of
       Income Tax clauses to declare annual accumulated gift
       values of over NT$1000earned by ROC citizens for tax
       deduction. All withholding tax statement will be sent out to
       the referrer in February of the following year. For non-ROC
       citizens, HSBC will deduct 20% of the gift value for tax in
        accordance with Clause 9.

10. Promotion Amendments and Termination
     HSBC reserves the right to amend, suspend, cancel and
     terminate this programme and any (or all) of its rules
     without need of prior notification. Amendments (if any)
     will become effective once announced on the HSBC website.
     Anything not aforementioned regarding the programme's
     regulations will be dealt with according to R.O.C laws.
